1. Introduction
Welcome to Snowbird Systems Inc. (“Service”). By subscribing to our service, you agree to be bound by these Terms of Subscription (“Terms”). Please read these Terms carefully.
2. Definitions
Subscriber: Any person or entity that subscribes to the Service.
Service: Refers to Snowbird Systems Inc.’s electronic monitoring device (“Device”) which includes sensors for temperature, humidity, power loss, and water detection, equipped with a battery backup and cellular connectivity. The Service also includes access to a web platform for viewing historical sensor data.
Subscription Fee: The fee charged for access to the Service as specified on our website or through direct communication.
3. Subscription Options
Monthly Plan: This subscription renews every month on the same day as the purchase. The fee for the Monthly Plan is charged at the beginning of each billing cycle.
Annual Plan: This subscription renews each year on the same day as the initial purchase. The fee for the Annual Plan is charged annually at the beginning of each billing cycle.
4. Subscription
Auto-Renewal: Both subscription plans will automatically renew at the end of each period unless canceled by the Subscriber.
5. Payment Terms
Payment: Subscription Fees will be charged at the beginning of each subscription period to the payment method provided by the Subscriber.
Change in Price: We reserve the right to change our Subscription Fees. Notice of changes will be sent via email to the address provided by the Subscriber.
6. Device Usage
Installation: The Device must be installed in a code compliant 120v wall outlet. Incorrect installation may void the warranty and could affect the functionality of the Device.
Data Accuracy: While we strive for accuracy, environmental factors might affect sensor readings. Snowbird Systems Inc. is not liable for inaccuracies in data collection or transmission.
7. Cancellation
Subscriber Cancellation: Subscribers may cancel their subscription at any time. However, there will be no refunds for the current billing period.
Service Cancellation: We reserve the right to cancel access to the Service for any reason at any time without prior notice.
8. Refund Policy
Refunds: Refunds are not available except in cases where the Service is discontinued by Snowbird Systems Inc..
9. Intellectual Property
Rights: All content, software, and materials available through the Service are the intellectual property of Snowbird Systems Inc. and are protected by copyright, trademark, and other intellectual property laws.
10. Liability
Limitation of Liability: To the fullest extent permitted by law, in no event shall Snowbird Systems Inc. be liable for any indirect, punitive, incidental, special, or consequential damages.
11. Data and Notifications

Data Collection: By using the Service, you consent to the collection and use of sensor data from your Device for the purpose of providing the Service.

Changes: Snowbird Systems Inc. reserves the right to modify these Terms at any time. Subscribers will be notified of significant changes via email or through our website.
13. Governing Law
Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of North Dakota, USA.
